3. Copyright Ownership
3.1 Website Content
All content published on this website is protected by copyright. Unless otherwise indicated, copyright in all content — including but not limited to the following — is owned exclusively by Fizzyhorizon, Unipessoal Lda.:
- All text, product descriptions, tasting notes, editorial articles, blog posts, guides, and written copy
- All photographs, product imagery, lifestyle images, and other visual content created for or by the Company
- All graphics, illustrations, icons, logos, and design elements
- All page layouts, information architecture, and user interface designs
- All video content, audio content, and multimedia materials
- All data compilations, databases, product catalogues, and curated product selections
- All software, source code, scripts, and technical implementations underlying the website
3.2 Automatic Protection
Under the Portuguese Copyright and Related Rights Code and the Berne Convention, copyright protection arises automatically upon creation of an original work. No registration is required for protection to subsist. All original works created by or for Fizzyhorizon, Unipessoal Lda. are protected from the moment of their creation, regardless of whether a copyright notice appears alongside them.
3.3 Duration of Protection
Copyright in our works is protected for the duration established by applicable law. Under Portuguese and EU law, copyright in most works subsists for the lifetime of the author plus 70 years. Works created by the Company as a legal entity (corporate works) are protected for 70 years from the date of publication or creation, as applicable under Portuguese law.
3.4 Third-Party Content
This website may contain content — including product images, brand names, logos, and descriptions — that is the property of third-party brands, producers, and rights holders. Such content is used under licence, with permission, or under applicable legal exceptions. The display of third-party intellectual property on this website does not constitute any claim of ownership by Fizzyhorizon, Unipessoal Lda. over such materials.
4. Trademark Rights
4.1 Johnny Grape — Registered Trademark
JOHNNY GRAPE is a registered trademark owned by Fizzyhorizon, Unipessoal Lda. The Johnny Grape trademark and associated branding — including the brand name, logo, wordmark, stylistic elements, trade dress, and any distinctive signs associated with the Johnny Grape brand — are protected under:
- The Portuguese Industrial Property Code (Decreto-Lei n.º 110/2018 de 10 de dezembro de 2018)
- EU Trade Mark Regulation (Regulation (EU) 2017/1001), where applicable
- The Madrid Protocol for international trademark registrations, where applicable
Unauthorised use of the JOHNNY GRAPE trademark, or any mark confusingly similar to it, in connection with the sale, promotion, advertising, or distribution of any goods or services — across all product and service categories, without exception — is strictly prohibited and constitutes trademark infringement under applicable Portuguese and EU law.
Any use of the Johnny Grape brand name, logo, or associated visual identity for commercial purposes requires the express prior written consent of Fizzyhorizon, Unipessoal Lda.
4.2 Other Marks
All other trademarks, service marks, trade names, product names, and logos displayed on this website that are not owned by Fizzyhorizon, Unipessoal Lda. are the property of their respective owners. Reference to third-party trademarks on this website does not imply any affiliation with, endorsement by, or sponsorship from those trademark owners, unless expressly stated.

For press assets and image permissions, please contact us at the details provided in Section 18 below.
5.3 No Commercial Licence
Nothing on this website shall be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any content, trademark, or other intellectual property owned by Fizzyhorizon, Unipessoal Lda. for commercial purposes without our express prior written permission.

8. Copyright Infringement and Takedown Policy
8.1 Our Commitment to Enforcement
Fizzyhorizon, Unipessoal Lda. takes the protection of its intellectual property seriously and actively monitors the internet — including foreign websites, online marketplaces, social media platforms, and search engines — for unauthorised use of our content, imagery, brand, and trademarks. We pursue infringement wherever it occurs, regardless of the country in which the infringing party is located.
We reserve the right to take all legal measures available to us under Portuguese law, EU law, and applicable international law against any person or entity that infringes our intellectual property rights. Such measures may include, without limitation:
- Issuing formal cease and desist notices to the infringing party
- Filing DMCA takedown requests with US-based platforms, hosting providers, and search engines
- Filing equivalent notice and takedown requests with platforms and hosts operating in other jurisdictions
- Requesting the de-indexing of infringing content from search engines, including Google, Bing, and others
- Reporting infringement to domain registrars and requesting domain suspension where applicable
- Initiating legal proceedings before the competent Portuguese courts and, where appropriate, courts in other jurisdictions
- Seeking injunctive relief to prevent ongoing or imminent infringement
- Claiming full compensatory and punitive damages, including loss of profits, loss of brand value, and legal costs, to the fullest extent permitted by law
- Reporting counterfeit or trademark-infringing content to customs authorities, marketplace trust and safety teams, and relevant regulatory bodies
We do not issue warnings before taking action in cases of clear, deliberate, or repeated infringement.
8.2 Cross-Border Infringement and Foreign Websites
We are aware that infringement of our intellectual property frequently originates outside Portugal and the European Union — including from websites hosted in the United States, the United Kingdom, and other jurisdictions. We actively pursue such infringement using the mechanisms available under international law and through the policies of major online platforms and service providers.
8.2.1 US-Hosted Websites and Platforms — DMCA
For content infringing our intellectual property that is hosted on US-based servers, platforms, or services, we rely on the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, which requires US-based online service providers to respond expeditiously to valid takedown notices. This includes, but is not limited to:
- Website hosting providers registered in the United States
- Social media platforms including Meta (Facebook and Instagram), X (formerly Twitter), TikTok, Pinterest, and YouTube
- E-commerce marketplaces including Amazon, eBay, and Etsy
- Search engines including Google and Bing, for purposes of de-indexing infringing content
- Cloud storage and content delivery networks
Where infringing content appears on a US-hosted platform, we will submit a formal DMCA takedown notice directly to that platform’s designated DMCA agent, as required under 17 U.S.C. § 512(c)(2). We have the right to do so as the rights holder, notwithstanding that we are a Portuguese company — the DMCA applies to any rights holder whose content is hosted on US infrastructure, regardless of where the rights holder is located.
8.2.2 EU and EEA Websites
For infringement occurring on websites and platforms hosted within the European Union or European Economic Area, we will pursue enforcement under:
- The EU Enforcement of Intellectual Property Rights Directive (2004/48/EC — IPRED), which harmonises remedies across EU member states
- The EU Digital Services Act (Regulation (EU) 2022/2065), which requires online platforms operating in the EU to have effective notice and action mechanisms for illegal content, including intellectual property infringement
- The EU Directive on Copyright in the Digital Single Market (2019/790/EU), which imposes obligations on content-sharing platforms regarding the licensing and takedown of protected content
- National copyright laws of the relevant EU member state, where applicable
8.2.3 UK-Based Websites
Following the United Kingdom’s departure from the European Union, infringement on UK-hosted websites is pursued under the Copyright, Designs and Patents Act 1988 (CDPA) and related UK intellectual property legislation, including through the UK Intellectual Property Office (UKIPO) where relevant.
8.2.4 Other International Jurisdictions
For infringement occurring in other countries, we will pursue enforcement through:
- The Berne Convention, to which over 180 countries are party, and which requires signatory countries to protect the copyright of rights holders from other member states
- The TRIPS Agreement, which sets minimum standards of intellectual property protection enforceable through the World Trade Organization (WTO)
- Local legal counsel and enforcement mechanisms in the relevant jurisdiction, where necessary
- Reports to the relevant national intellectual property office or enforcement authority
8.3 Reporting Infringement of Our Rights
If you become aware of any website, platform, marketplace, or individual making unauthorised use of our content, trademarks, imagery, or other intellectual property — whether within Europe or internationally — please notify us immediately so that we may take appropriate action.
We take all reports seriously and will investigate promptly.
To report infringement of our intellectual property rights, please contact us at:
Email: [email protected]
Subject line: Intellectual Property Infringement Report
Postal address: Fizzyhorizon, Unipessoal Lda., Aldeamento de Porches Lote 22B, 8400-498 Porches, Portugal
Please include as much of the following information as possible in your report:
- A description of the intellectual property right that has been infringed (e.g. specific image, product description, logo, trademark)
- The URL(s) or exact location(s) where the infringing material appears
- The name or identity of the infringing party, if known
- Screenshots or other evidence of the infringement
- The date on which you first became aware of the infringement
- Your contact details
The more detail you can provide, the more quickly we can act. You are not required to submit a formal legal notice — an informal report with supporting evidence is sufficient for us to begin an investigation.
8.4 DMCA Notice and Takedown — Third-Party Claims Against This Website
If you are a rights holder and believe that content published on this website infringes your copyright or other intellectual property rights, you may submit a formal infringement notice to us. This process operates under the EU E-Commerce Directive (2000/31/EC) and the EU Digital Services Act, and additionally under the US Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512(c), to the extent applicable.
To be valid, your notice must include all of the following:
- Identification of the copyrighted work claimed to have been infringed — or, if multiple works are covered by a single notification, a representative list of such works
- Identification of the infringing material and its location — specifically, the URL(s) on this website where the material appears, with sufficient detail to allow us to locate and identify it
- Your full contact information, including your legal name, postal address, telephone number, and email address
- A statement of good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law
- A statement of accuracy and authority, made under penalty of perjury where applicable, confirming that the information in your notice is accurate and that you are the copyright owner or are duly authorised to act on behalf of the copyright owner
- Your physical or electronic signature
Incomplete notices that do not include all required elements may not be actioned. Please send your complete notice to:
Email: [email protected]
Subject line: Copyright Infringement Notice / DMCA Takedown Request
Postal address: Fizzyhorizon, Unipessoal Lda., Aldeamento de Porches Lote 22B, 8400-498 Porches, Portugal
We will acknowledge receipt of valid notices and will act expeditiously to investigate and, where appropriate, remove or disable access to the infringing material. We reserve the right to forward the substance of infringement notices to the person or entity responsible for the allegedly infringing content.
Important: Submitting a false, misleading, or bad faith infringement notice may expose you to legal liability for damages, including costs incurred by us and by the alleged infringer. If you are uncertain whether material infringes your rights, we recommend obtaining legal advice before submitting a notice.
8.5 Counter-Notice Procedure
If you are the subject of a takedown action and you believe that the content removed from this website was removed in error or as a result of misidentification, you may submit a counter-notice to us.
Your counter-notice must include:
- Identification of the material that was removed and the location at which it appeared before removal
- A statement under penalty of perjury (where applicable) that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your full name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the competent courts of Portugal, and that you will accept service of process from the person who submitted the original notice
- Your physical or electronic signature
Counter-notices should be sent to the same contact details set out in Section 8.4 above, with the subject line: DMCA Counter-Notice.
Upon receipt of a valid counter-notice, we will review the matter and may restore the removed content at our discretion, subject to the applicable legal framework.
8.6 Repeat Infringers
In accordance with the requirements of the DMCA and consistent with EU platform obligations under the Digital Services Act, Fizzyhorizon, Unipessoal Lda. maintains a policy of terminating, in appropriate circumstances and at our sole discretion, access to this website for users who are repeat infringers of intellectual property rights.
8.7 Search Engine De-indexing
In addition to direct takedown notices to hosting providers and platform operators, we actively submit de-indexing requests to major search engines — including Google (via the Google Search Console) and Microsoft Bing — to remove infringing URLs from search results. This is a separate and complementary action to the removal of infringing content from the source website and may be pursued independently.
8.8 Marketplace and Social Media Enforcement
Fizzyhorizon, Unipessoal Lda. actively monitors and enforces its intellectual property rights across all online marketplaces, e-commerce platforms, and social media networks on which our content, brand, or products may appear — whether or not we operate an official presence on those platforms.
This includes enforcement against unauthorised sellers listing products under the JOHNNY GRAPE trademark, third parties using our product imagery or descriptions without permission, accounts or pages impersonating our brand, and any other use of our intellectual property that has not been expressly authorised by us.
We utilise the intellectual property reporting, brand protection, and rights management tools made available by platform operators, as well as direct legal action where platform-level remedies are insufficient. The absence of an official Johnny Grape presence on any given platform does not limit our right to enforce our intellectual property on that platform.
If you are a marketplace operator, platform trust and safety team, or social media network that has received a complaint or enquiry relating to Johnny Grape or Fizzyhorizon, Unipessoal Lda., please contact us directly at [email protected].
9. Database Rights
This website and its contents, including the product catalogue, tasting notes database, and content archives, may constitute a protected database under the EU Database Directive (96/9/EC) as transposed into Portuguese law. Fizzyhorizon, Unipessoal Lda. asserts its database rights in any such compilation. Systematic extraction or re-utilisation of any substantial part of the contents of this website’s database is prohibited without our express written consent.
10. Moral Rights
Under the Portuguese Copyright and Related Rights Code, authors of original works hold moral rights (direitos morais) in addition to economic rights. Moral rights are personal, inalienable, and non-transferable under Portuguese law. They include the right of attribution (the right to be identified as the author of a work), the right of integrity (the right to object to derogatory treatment of a work that would harm the author’s honour or reputation), and the right of disclosure (the right to decide when and how a work is first made public).
Fizzyhorizon, Unipessoal Lda. asserts all applicable moral rights in the original works created by or on behalf of the Company. Any use of our content that distorts, mutilates, modifies, or otherwise treats our works in a manner that is prejudicial to the honour or reputation of the Company or its creators is strictly prohibited, in addition to constituting a violation of our economic copyright.
Where users or third parties submit content to this website (for example via reviews, comments, or other user-generated features), they hereby waive any moral rights they may hold in such content to the fullest extent permitted by applicable law, in favour of Fizzyhorizon, Unipessoal Lda.
11. Trade Dress and Packaging Rights
The visual identity of the Johnny Grape brand — including the distinctive appearance, design, colour scheme, layout, and overall presentation of our product packaging, labels, bottles, and branded materials — constitutes protected trade dress under applicable Portuguese and EU intellectual property law. This visual identity has been developed exclusively by or for Fizzyhorizon, Unipessoal Lda. and serves as a distinctive identifier of origin.
Any reproduction, imitation, or adaptation of our trade dress — whether on competing products, packaging, marketing materials, or digital content — that is likely to cause confusion among consumers as to the origin of goods or services is strictly prohibited and may constitute both trademark infringement and unfair competition under applicable law.
This protection extends to the overall look and feel of the Johnny Grape brand, including any distinctive bottle shapes, label designs, colour combinations, typographic styles, and visual arrangements that are associated with the Johnny Grape name.
12. Domain Names and Online Brand Protection
The domain name johnnygrape.com and all associated domains, subdomains, and domain variants registered by Fizzyhorizon, Unipessoal Lda. are the exclusive property of the Company.
Cybersquatting and typosquatting — the registration or use of domain names that are identical or confusingly similar to the JOHNNY GRAPE trademark, or that incorporate our brand name with minor variations for the purpose of diverting traffic, misleading consumers, or otherwise trading on our reputation — is strictly prohibited. We will pursue the cancellation or transfer of such domain names through the Uniform Domain-Name Dispute-Resolution Policy (UDRP) administered by the World Intellectual Property Organization (WIPO), through national dispute resolution mechanisms, and through direct legal action where necessary.
We also prohibit the use of our brand name, trademarks, or variations thereof in:
- Paid search advertising — bidding on our trademark as a keyword in pay-per-click advertising without our authorisation
- Metatags and hidden keywords — incorporating our brand name in website metadata, hidden text, or other technical elements to attract search engine traffic
- Social media handles and usernames — creating accounts, pages, or profiles using our brand name or confusingly similar names without authorisation
- Email addresses and display names — using our brand name in email addresses or display names in a manner that could mislead recipients into believing they are communicating with an official Johnny Grape representative

13.3 Unsolicited Submissions
Unless specifically requested by us in writing, we do not solicit and do not wish to receive confidential, proprietary, or creative submissions — including ideas, concepts, business proposals, brand suggestions, or creative materials — through this website, by email, or by any other means. You may link to the homepage of this website, provided that you do so in a way that is fair, legal, and does not damage our reputation or take advantage of it. 15.3 Limitation of Liability
To the fullest extent permitted by applicable law, Fizzyhorizon, Unipessoal Lda. and its directors, employees, agents, and representatives exclude all liability for any loss or damage — whether direct, indirect, consequential, incidental, or otherwise — arising out of or in connection with:
- Your use of, or inability to use, this website or any content on it
